This paper analyses the regulation of inter-firm contracting in Germany, Britain and Italy. Contrary to earlier empirical studies and to models drawn from transaction-cost theory, we find that contract law may play an important role in underpinning long-term, cooperative relationships and in fostering trust. The impact of contract law depends on the relationship between the legal system and other forms of institutional regulation, including trade associations and standard-setting bodies. Law and Social Norms

This issue of Erasmus Law Review explores the relation between law and society by investigating different conceptions of social norms. The idea of this special issue saw the light of day during the meetings of a discussion group that we organised for our fellow PhD candidates of the Erasmus Graduate School of Law EGSL. The aim of the discussion group was to stimulate debate among peers and thereby benefit from the diverse disciplinary backgrounds of the participating PhD candidates and guest speakers. In exploring the relation between law and society we have found it both helpful and challenging to focus, in particular, on the relation between legal and social norms. Understanding Compliance Differences between Legal and Social Norms: The Case of Smoking Ban

Despite numerous challenges, since its independence, Uzbekistan, with the exception of the May Andijan events, has enjoyed extraordinary political stability and not recorded any considerable cases of interethnic or interfaith conflict, regime change or civil war, whereas neighboring Kyrgyzstan, labeled an "island of democracy" by the Western world, has experienced numerous conflicts and chaos, ranging from "color revolutions" to ethnic conflict. However, for understanding Uzbekistan's ability to cope with internal and external challenges, little recourse is made to the post-independence discourse on public administration known as "mahalla reforms". In spite of the significant existing body of literature on the mahalla, there has been little systematic scholarly investigation of the role of mahalla in maintaining political stability and security in Uzbekistan. Previous studies did not provide an account of how the law, social norms and welfare come to interplay in the mahalla system and how this influences the public administration developments in Uzbekistan.

Legal norms are often seen as a means to regulate behaviour when neither self-interest nor social norms produce the desired behaviour in individuals. This suggests, on the one hand, that the law should regulate those areas in which social norms do not exist and provide support and extra enforcement in those areas where social norms exist. It also suggests on the other hand that there seems to be no questioning of the intrinsic efficiency and fairness of existing social norms. This article first looks at the genesis of social norms and the mechanism of their enforcement. This allows a closer inspection of the efficiency and fairness concepts.

The values shared within a society influence the social behaviour of the agents in that society. This connection goes through implicit and explicit norms. Agents act in situations where different, possibly conflicting, norms are applicable. In the case of a norm conflict, an agent will decide to comply with one or more of the applicable norms, while violating others. Our interest is how the type of the norms may play a role in such decision, and take the chosen behaviour of an agent to depend on a personal preference order on the norm types.

What is the role of law in a society in which order is maintained mostly through social norms, trust, and nonlegal sanctions? Eric Posner argues that social norms are sometimes desirable yet sometimes odious, and that the law is critical to enhancing good social norms and undermining bad ones. But he also argues that the proper regulation of social norms is a delicate and complex task, and that current understanding of social norms is inadequate for guiding judges and lawmakers. What is needed, and what this book offers, is a model of the relationship between law and social norms. The resulting behavioral patterns are called social norms. Posner applies the model to several areas of law that involve the regulation of social norms, including laws governing gift-giving and nonprofit organizations; family law; criminal law; laws governing speech, voting, and discrimination; and contract law. Among the engaging questions posed are: Would the legalization of gay marriage harm traditional married couples?
